Women Quota Law Extends to J&K and Puducherry

Law comes into force in Union Territories

Women Quota Law Extends to J&K and Puducherry: The women’s reservation framework has officially been implemented in the Union Territories of Jammu and Kashmir and Puducherry from April 17, 2026. This follows the earlier enforcement of the Constitution (106th Amendment) Act, 2023 on April 16, 2026.

The reform provides one-third reservation for women in the Lok Sabha, State Legislative Assemblies, and Delhi Assembly. It represents a major step toward strengthening women’s participation in governance.

Static GK fact: The Indian Parliament consists of the President, Lok Sabha, and Rajya Sabha.

Constitutional framework of reservation

The 106th Constitutional Amendment Act, 2023 establishes the legal basis for 33% reservation for women in legislative bodies. It is popularly known as the Women’s Reservation Act.

The amendment introduces provisions ensuring women’s representation across multiple levels of governance. However, its implementation depends on specific conditions linked to electoral boundaries.

Static GK Tip: Constitutional amendments in India are governed under Article 368 of the Constitution.

Separate legal provisions for UTs

Unlike states, Union Territories with legislatures require separate legal backing. For Puducherry, provisions were added through the Government of Union Territories (Amendment) Act, 2023.

For Jammu and Kashmir, changes were introduced via the J&K Reorganisation (Second Amendment) Act, 2023. These laws ensure that reservation provisions are legally applicable in these UT assemblies.

Static GK fact: Jammu and Kashmir became a Union Territory in 2019 after reorganisation.

Role of delimitation and Census

Although the law is now active, actual reservation will not apply immediately. Implementation is linked to the first delimitation exercise conducted after the next Census.

The upcoming Census 2027, scheduled between April 1, 2026, and March 1, 2027, will form the basis for redrawing constituencies. Only after this process will reserved seats for women be allocated.

Static GK Tip: Delimitation is the process of redrawing electoral constituencies based on population changes.

Political developments and challenges

In 2026, key bills such as the Constitution (131st Amendment) Bill, Delimitation Bill, and Union Territories Laws (Amendment) Bill were introduced to enable implementation from 2029, but they were defeated in the Lok Sabha.

Despite this, the 106th Amendment Act remains valid, ensuring that the legal framework for women’s reservation is intact. Political debates continue regarding the timing and execution of delimitation.

Static GK fact: Lok Sabha is the lower house of Parliament, directly elected by citizens.

Way ahead

The extension of the law to Jammu and Kashmir and Puducherry marks an important administrative step. However, the actual impact will depend on delimitation and electoral cycles.

The reform is expected to significantly enhance women’s political representation, though its full benefits will be visible only after implementation stages are completed.
