Cabinet Clears Judicial Expansion
Supreme Court Judge Expansion Plan 2026: The Union Cabinet led by Narendra Modi approved a proposal on 5 May 2026 to increase the strength of the Supreme Court of India from 34 to 38 judges, including the Chief Justice of India (CJI). This means the number of judges excluding the CJI will rise from 33 to 37.
The proposal will be introduced through the Supreme Court (Number of Judges) Amendment Bill, 2026. The move aims to improve judicial efficiency and ensure quicker disposal of pending cases across the country.

Need for More Judges
India’s judiciary has been facing a continuous rise in pending cases for several years. The Supreme Court handles constitutional disputes, civil appeals, criminal matters, and public interest litigations. Increasing litigation has placed heavy pressure on existing judges.
The addition of four more judges is expected to help in faster constitution of benches and quicker hearings. It may also reduce delays in delivering judgments and strengthen public confidence in the judicial system.
Judicial backlog remains one of the major governance challenges in India. The expansion of judge strength is considered an important administrative reform for ensuring speedy justice.

Constitutional Provision
The composition of the Supreme Court is governed by Article 124(1) of the Constitution of India. The Article states that the Supreme Court shall consist of the Chief Justice of India and such number of judges as Parliament may prescribe by law.
Initially, the Constitution allowed only seven judges besides the Chief Justice. Over time, Parliament amended the law several times to increase the sanctioned strength according to rising judicial needs.
The proposed amendment in 2026 reflects the growing importance of constitutional courts in a large democratic country like India.
Historical Growth of Supreme Court Strength
The Supreme Court (Number of Judges) Act, 1956 originally fixed the judge strength at 10, excluding the CJI. As population and litigation increased, the strength was revised periodically.
In 1960, the strength increased to 13 judges. It later rose to 17 in 1977, 25 in 1986, and 30 through the 2008 amendment. The last major expansion happened in 2019, when the strength increased from 30 to 33 judges.
The latest proposal to raise the strength to 37 judges excluding the CJI marks another important phase in India’s judicial reforms.

Financial Implications
