New Proposal to Prevent Public Misuse of Dead Bodies
Tamil Nadu Panel Proposes ‘Honour of Dead Body Act’ to Prevent Protest Misuse : The Fifth Tamil Nadu Police Commission has made a significant recommendation to introduce a new legislation titled the “Tamil Nadu Honour of Dead Body Act”. This proposed law aims to prevent the use of dead bodies in protests, especially when relatives or supporters block roads to demand compensation or police action. The commission views this trend as a public order threat and legal misuse, urging strong legal boundaries.
Rationale Behind the Recommendation
In several recent instances across Tamil Nadu and other states, families have refused to cremate the deceased, using the body as leverage to pressurise authorities. Such actions, while emotionally charged, are seen as disruptive to public order, especially when they block essential services or highways. The Commission argues that this erodes the dignity of the deceased and transforms grief into a tool of political or social coercion.
Key Provisions of the Proposed Act
If enacted, the Tamil Nadu Honour of Dead Body Act would make it illegal to protest with a corpse in public spaces such as roads or hospitals. Any such demonstration involving dead bodies to extract immediate action from police or government would be a criminal offence, attracting imprisonment of up to five years. The law will not interfere with legitimate legal remedies or postmortem procedures, but will prohibit obstruction of public spaces or institutions.
Rajasthan’s Precedent and Legal Framework
Rajasthan became the first Indian state to enact an Honour of Dead Body Act in 2023. That law prohibits using dead bodies in agitations and sets similar penalties for violators. Inspired by that, Tamil Nadu’s proposed version seeks to create legal clarity on handling sensitive deaths, including custodial or encounter cases, where public outrage is common. The Tamil Nadu law, if passed, would mark the second such initiative in India.
