Recent Government Decision
Tamil Nadu Information Commission Expansion: The Tamil Nadu Government has decided to appoint two additional State Information Commissioners to the Tamil Nadu Information Commission. This move aims to strengthen the institutional capacity of the Commission in handling information-related appeals and complaints.
With the proposed appointments, the Commission will consist of one State Chief Information Commissioner (SCIC) and eight State Information Commissioners (SICs). This expansion reflects a renewed focus on improving transparency and citizen access to information.
Present Strength of the Commission
At present, the Tamil Nadu Information Commission is functioning with one SCIC and five SICs. This is below the permissible strength allowed under the law.
Due to vacancies, the Commission has been facing a heavy pendency of cases. The addition of two more commissioners is expected to reduce delays in adjudicating RTI appeals.
Evolution of the Commission
The Tamil Nadu Information Commission was established in 2005, following the enactment of the Right to Information Act, 2005. Initially, the Commission consisted of one SCIC and two SICs.
In 2008, the number of State Information Commissioners was increased to six, reflecting rising public use of the RTI mechanism. Over time, vacancies and retirements reduced the effective strength.
Static GK fact: Tamil Nadu was among the early states to operationalise the RTI framework soon after the Central Act came into force.
Legal Provisions Under RTI Act
The structure and strength of State Information Commissions are governed by Section 15(2) of the RTI Act, 2005. As per this provision, a state may appoint up to 10 State Information Commissioners, in addition to the SCIC.
The Act gives states flexibility to decide the number of commissioners based on administrative requirements. Tamil Nadu’s proposed strength of eight SICs remains within the statutory limit.
Static GK Tip: The appointment of the SCIC and SICs is made by the Governor on the recommendation of a committee headed by the Chief Minister.
Role and Importance of the Commission
The Tamil Nadu Information Commission acts as a quasi-judicial body. It hears appeals and complaints from citizens who are denied information by public authorities.
The Commission has powers to summon officials, impose penalties, and issue directions for disclosure of information. Its effective functioning is crucial for ensuring administrative accountability.
By increasing the number of commissioners, the state aims to enhance the efficiency and credibility of the RTI mechanism.
Static GK fact: Information Commissions are independent statutory bodies and are not subject to control of any ministry or department.
Administrative and Governance Impact
The expansion is expected to speed up disposal of pending RTI cases. It also signals the government’s commitment to open governance and transparency.
A stronger Commission improves citizen trust and strengthens democratic oversight. This decision aligns with broader administrative reforms in Tamil Nadu.
