Background of the White Paper

India’s Techno-Legal Shift in AI Governance: India released a White Paper on “Strengthening AI Governance Through Techno-Legal Framework” on 24 January 2026. It was issued by the Office of the Principal Scientific Adviser (OPSA), marking a major policy shift in how artificial intelligence is regulated.

The document moves away from traditional command-and-control regulation. Instead, it promotes a techno-legal model that integrates law, ethics, and technology directly into AI system design and deployment.

This approach aims to ensure responsible innovation without slowing down India’s digital transformation and AI ecosystem.

Governance by Design

The framework introduces Governance by Design, where legal and ethical safeguards are embedded at the AI design stage itself. Compliance is not treated as a post-deployment check but as a built-in system feature.

This approach reduces the need for heavy external enforcement. It also makes accountability a technical property of AI systems rather than only a legal obligation.

Risk-Proportionate Regulation

This structure prevents overregulation while ensuring public safety.

Human Oversight Mechanism

The framework mandates human supervision at critical decision points. AI systems cannot function as fully autonomous authorities in high-impact decisions.

Human oversight acts as a fail-safe layer to prevent automated harm, algorithmic bias, and unjust exclusion.

Lifecycle-Based AI Governance

Governance operates across the entire AI lifecycle. This includes data collection, model training, deployment, and real-world use.

Implementation Challenges

One major challenge is privacy versus performance. Large-scale data erasure can reduce model accuracy, especially for linguistically and culturally underrepresented groups.

Another issue is the AI user–AI subject divide. In Indian welfare systems, citizens are often subjects of AI decisions, not active users, limiting their ability to contest outcomes.

Cross-border AI models pose regulatory risks. Models trained abroad may not embed Indian safeguards, creating jurisdictional governance gaps.

Compliance mechanisms can also impact system accuracy, creating trade-offs between regulation and efficiency.

Institutional Architecture

The White Paper proposes a whole-of-government approach. It recommends the creation of dedicated bodies such as the AI Governance Group (AIGG) for inter-ministerial coordination.

The Technology and Policy Expert Committee (TPEC) is proposed to integrate law, policy, ethics, and AI safety expertise into governance.

This ensures institutional coherence rather than fragmented regulation.

Technological Enablers

Key technologies will support governance implementation. These include Machine Unlearning for the right to erasure and Synthetic Data for privacy preservation.

Content Provenance tools such as watermarking and metadata help detect deepfakes and manipulated content. Integration with Digital Public Infrastructure like Aadhaar and UPI strengthens verification and trust frameworks.

DEPA Integration

The framework uses Data Empowerment and Protection Architecture (DEPA) for consent-driven data sharing. It enables trusted execution environments and user-controlled data flows.

This ensures that AI development aligns with data sovereignty and individual consent models.
