A Historic Appointment at the Helm of Judiciary
Justice B.R. Gavai to Take Oath as India’s 52nd Chief Justice: In a historic development, Justice Bhushan Ramkrishna Gavai has been named the 52nd Chief Justice of India, following an official announcement by President Droupadi Murmu on April 30, 2025. His elevation to the highest judicial post is not only momentous but also deeply symbolic, as he becomes only the second individual from the Scheduled Caste community, after Justice K.G. Balakrishnan, to head the Indian judiciary. His swearing-in ceremony is scheduled for May 14, 2025, and he will serve until November 23, when he reaches the retirement age of 65.
Judicial Journey and Noteworthy Judgments
Justice Gavai commenced his legal career in 1985 and went on to serve as a judge of the Bombay High Court starting in 2003. His judicial journey progressed further when he was elevated to the Supreme Court of India in 2019.Over the years, he has been part of major decisions that shaped Indian constitutional law. Justice Gavai was part of the constitutional bench that upheld the abrogation of Article 370, a landmark ruling that revoked the special status of Jammu & Kashmir. His opinions also featured in the Supreme Court’s judgment against the Electoral Bonds Scheme, citing concerns about transparency in political funding.
Additionally, Justice Gavai supported the majority in the 2016 demonetisation verdict and contributed to another significant ruling allowing sub-categorisation within Scheduled Castes for reservation benefits. He also delivered a strong verdict stating that property demolitions must be preceded by a show-cause notice and a minimum 15-day response period, reinforcing procedural rights.
Role in Social Representation and Judiciary
Justice Gavai’s elevation has been widely appreciated for bringing social diversity to the highest judicial post. His background stands as a symbol of inclusion and access to the top levels of India’s judiciary for historically underrepresented communities. His tenure may be short, but it represents a meaningful shift in how representation and merit are viewed within the Supreme Court.
Duties and Responsibilities Ahead
As the new Chief Justice of India, Justice Gavai will oversee key constitutional benches, make judicial appointments, and lead judicial reforms. With legal challenges constantly evolving—especially in areas such as electoral transparency, environmental protection, and social justice—his leadership is expected to leave a lasting impression.
